Terms for Testimonial/Image Use

1. For value received, you represent and warrant that the Testimonial given is original and does not infringe upon the copyright or other proprietary rights of any other person or entity.
2. You agree that Smart Commute Mississauga shall own all rights to the Testimonial/image uploaded. You also agree that Smart Commute Mississauga has the right to use or not to use the Testimonial/image and to use, reproduce, re-use, modify, edit or change the Testimonial/image and your name and likeness for any purpose as Smart Commute Mississauga sees fit.
3. You irrevocably consent to and authorize Smart Commute Mississauga to use your name/image/testimonial in illustrations, advertising and publicity material on behalf of Smart Commute Mississauga.
4. You agree to indemnify and release Smart Commute Mississauga from any liabilities arising out of or relating to your providing said Testimonial/image.

By agreeing to these terms, I hereby release and forever discharge Smart Commute Mississauga from all liability, whether direct or indirect, and hereby waive all claims, demands, actions and causes of action which I have or may have against Smart Commute Mississauga with respect to or arising from the use by Smart Commute Mississauga of my name, image and testimonial. I agree to and accept the possibility of flaws, distortions and inaccuracies in the reproduction of the image/name/testimonial use of myself for whatever reason.

I further acknowledge that, and consent to, the use by Smart Commute Mississauga of my name/image/testimonial of myself, without restriction.
